There are frustrations in the lives of civil litigators.

I suppose it is a little like golf where you’re inches from the cup, your prickly golfing buddie won’t give you the “gimme,” you putt and you miss…(Your fault for golfing with a putz. Just saying.)

How about seeking a default judgment against an unrepresented litigant who has not appeared in the case and has no defense against the claims in the lawsuit. You served her with the lawsuit, she fails to respond, you bring a motion for default judgment against her and you LOSE the motion.

Practice pointer: first go to the clerk of court to get the default entered on the docket, then move for entry of the default judgment
