Midland Funding undoubtedly hoped that the challenges to its debt-collecting practices would be laid to rest when it settled a three-year class action lawsuit in the Northern District of Ohio but it was not to be.

Last week, United States District Court Judge David A. Katz held that the State of Minnesota’s action against Midland Funding could go forward and was not precluded by Midland’s resolution of the class action against it.  (Minnesota AG Lori Swanson announced the action in late March. (Strib coverage here.))  (Query:  Anyone know the case number for the action filed by the state in Hennepin County? (Did the state actually FILE the complaint? It does not appear so from Minnesota court records.  Query: Why does the AG post a press release but not the complaint?)
