Who knew? Most people associate Wham-O with the frisbee or the hula hoop.  But do not forget the Superball and “a number of other extreme sports and swim products.”

Apparently, in addition, Wham-O has what might be a risky business strategy.  At least Eden Prairie-based former Wham-O sales rep (over decades) Toy’N Around Inc. alleges that Wham-O terminated Toy’N Around without any cause and without any notice.  That does not fly under Minnesota’s termination of sales representative statute.  (Toy’N Around Complaint here.) Are things as bad for Wham-O here as they look? Time’ll tell. If so, count on a stipulation for dismissal (that is, a quick settlement) within the next 60 days.
